1. GENERAL

These General Conditions of Sale (the “Conditions of Sale”) define the contract (the “Contract”) between the customer (the “Customer”) and SAS Marée Haute (the “Sellers”) whose head office is located at 16 ter rue Raymond Grandsart, registered in the La Rochelle trade and companies register under SIREN number 890 298 128, whose share capital is €5,000. The director is Baptiste Bourgoin.

This site is hosted by the company HOSTINGER INTERNATIONAL LTD, whose head office is located at 61 Lordou Vironos Street, 6023 Larnaca, Cyprus, which can be reached by the following means: https://www.hostinger.fr/contact.

The general conditions of sale apply, without restriction or reservation, to the acquisition of all products or services (the “Orders”) on site, by telephone, online on the site www.mareehaute.vin (the “Site ") or by other means between Sellers and individual consumers and non-professionals. Placing an order implies unreserved acceptance by the Customer of the General Conditions of Sale which prevail over all other general or specific conditions not expressly authorized by the Sellers. Marée Haute reserves the right to adapt or modify the Terms and Conditions at any time. In the event of modification, only the agreement in force on the day of the order will be applied.

2. PRICES

Sales prices are in Euros (€), all taxes included. Any price change will be reflected on the Site. Prices do not include insurance or delivery charges where these may apply. Shipping costs are calculated separately and included in the final invoice. The delivery costs shown may only be an estimate of the final delivery costs.

The products and services sold under this Agreement will only become the property of the Customer after full payment by the latter. In the event of deferred payment, the product(s) will remain the property of the sellers until full payment has been made in accordance with these contractual conditions, even in the event of insolvency proceedings against the customer, in accordance with articles L. 621 -28 e et seq. of the Commercial Code.

All offers and prices are subject to availability. In the event that a product is not available after ordering, the customer will be informed by email, telephone or postal mail. Sellers will offer an identical product at a similar price or the option to wait until the product is in stock. If these alternatives are not accepted by the Customer, the order will be modified or canceled. In the case of a canceled order, when payment has already been made, the Customer will be reimbursed within 30 working days.

3. PAYMENT TERMS

Full payment must be made at time of order. Payment can be made by the following means:

Credit Card: American Express, Visa or Mastercard

You may be asked to provide certain information related to your payment, including your credit card number, the expiration date of your credit card, your billing address, and your shipping information. For more information on how we manage your information, please refer to our Privacy Policy on the Site.

You represent and warrant that: (i) you have the legal right to use any credit card or other payment method in connection with any Purchase; and that (ii) the information you provide to us is true, correct and complete.

The Service may use third-party services to facilitate payment and completion of purchases. By submitting your information, you grant us the right to provide such information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

4. FAILURE TO PAY

Sellers reserve the right to refuse to honor an order placed by a customer who has not paid in full or in part for an order or in the case of a previous order of the customer not paid, in whole or in part, or in case of ongoing settlement dispute.

5. VALIDATION OF THE ORDER

An order is considered “confirmed” when full payment for the order has been received. Order confirmations are sent by e-mail to the customer's address mentioned on the order form. It is the customer's responsibility to provide a valid email address for order confirmation. Confirmation of an order implies total and unreserved acceptance of these General Conditions by the Customer, acknowledgment of having read them in addition to waiving their own conditions of purchase or any conditions not mentioned. herein.

6. CANCELLATION

When the product(s) have been collected by a customer or the service(s) delivered to the customer, the order is final and cannot be canceled or returned. For orders for products placed online on the Site, in accordance with the legal provisions in force, the Customer has the right to cancel, without giving a reason or paying a penalty, within fourteen (14) days from the date of receipt of the ordered items.

Services that have not yet been delivered to the customer may be canceled up to 24 hours before delivery. Beyond this period, services such as Tasting Experiences, School V courses and private events will not be canceled and refunds will not be possible. Services canceled on time will be refunded by a chosen payment method within fourteen (14) days of receipt of cancellation notice.

In case of cancellation within the specified period, only the price of the product(s) and/or services purchased and the delivery costs will be refunded. All costs and expenses incurred in returning the product(s) are the responsibility of the customer.

Customers can cancel their order by sending an email and using the format below to glouglou@mareehaute.vin or by mail to the address below. Product orders must be returned to Tide Haute intact, in their original condition, in their original packaging, including all accessories, no later than fourteen (14) days after the cancellation request, at the following address:

The purchase price of the product(s) and delivery costs will be refunded by a chosen payment method within fourteen (14) days following receipt and verification of the products by Marée Haute. In the absence of return of the product(s) or proof of display within the required time frame, Marée Haute reserves the right to defer reimbursement until receipt of the product. Incomplete or damaged items will not be eligible for exchange or refund.

7. DELIVERY

Orders are delivered by mail or express delivery exclusively to the address indicated on the order form. Sellers will do everything in their power to honor delivery within a reasonable time, but cannot be held responsible for delays beyond their control. Standard delivery is made within five (5) working days* from the date of dispatch, for small and medium-sized packages delivered within mainland France. For delivery outside France: the Customer must submit a signed Purchase Order in order to obtain a quote for insurance, customs and delivery costs.

Any order delivered outside France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These taxes and possible customs duties linked to the delivery of an item are the responsibility of the Customer and are their responsibility. The Seller is not required to check and inform the Customer of applicable customs duties and taxes. To find out about them, the Customer can obtain information from the competent authorities in their country.

For deliveries to the United States of America, the recipient must be over 21 years old and proof of identity will be requested upon delivery.

8. PRODUCT VERIFICATION

Upon delivery, the Customer must check the product(s) and, in the event of material damage, refuse the damaged goods and return them to the Sellers. When the customer accepts delivery from the carrier, the delivery is accepted and the product is verified. In the event of a refused shipment, the customer must clearly identify the damage and specify it on the carrier's delivery manifest. The copy of the manifest must be sent, including the reasons for refusal of shipment, to the Sellers within 48 hours, by e-mail to glouglou@mareehaute.vin or by post to the following address:

If a damaged package has been delivered and the customer has signed the delivery note without modification or reservation, the product is considered accepted by the customer and the Sellers cannot be held responsible for any damage nor be responsible for any compensation. The words “subject to unpacking” have no legal or commercial value.

9. RESPONSIBILITY

Marée Haute is only bound by an obligation of means. It cannot be held liable for damage resulting from improper use or other problems beyond the control of the Sellers, including an event of force majeure.

10. COMPETENT COURT

The conditions of sale are subject to French law. The language in which this contract has been registered is French. Any translation on the site is given for information purposes only. With the exception of persons for whom the competent courts are determined by the decision of the Code of Civil Procedure, the Commercial Court of La Rochelle is the only competent authority in the event of a dispute. This jurisdiction also applies even in the case of multiple defendants or recourse to the guarantee.
